Selling a used ex Hong Kong iphone 3 GS which was refurbished with non genuine parts

I purchased an Apple iphone3GS 32GB Mobile phone from Techoni Technologies and had to wait 2 weeks with no reply from them. Finally I telephone Techoni Technologies only to be advised that they had been out-of-stock. However, a new shipment had arrived and Techoni were waiting for them to be ‘cleared’ by the Customs and Techoni will send it within next 2-3 days. The iphone3GS arrived within 5 days. After using it for 2.5 weeks the iphone’s battery wasn’t holding a Full Charge and was fully discharging after 2 hours use. So I took iphone3 into the Perth CBD Apple Store, only to be informed that the iphone3GS 32GB was 'used’ and ‘2 years old'. Also that the iphone had been 'refurbished with non genuine Apple Parts' and the serial number revealed that the iphone3 was ex Hong Kong. With that, Apple 'denied to service it' under those grounds. The iphone3GS was purchased the under the understanding that it was a Brand New and genuine Apple iphone3 and officially unlocked. In light of the above, Techoni Technologies has been misleading and totally deceptive conduct. They have also offered unacceptable quality of the iphone and under law Techoni has failed to disclose relevant facts which is a breach of the Australian Consumer Law. They have also made untruthful, dishonest, unfair and unlawful statements in their website advertisements. Also when goods fail to meet a consumer guarantee, the consumer can also claim for consequential losses for time and money and in this case the above issue is affecting my business and livelihood. Whether Techoni intended to mislead or be deceiving about the quality of consumer goods is irrelevant under the circumstances and Maximum Criminal Penalties should be imposed. The above has been reported to Apple’s Head Office in Sydney and I await the result.
