Refusing to accept areturn of a damaged item

X5.com.au is a reverse auction site.
I joined approx' 2 mnths ago and have had a string of complaints about both the business practises and the unstable operating system of X5.

The curtain call for me is when I tried to unsubscribe today - I could not find a clear link or button anywhere.
The other options (Personal info & Password) both returned a parsing error in the program & could not display personal details.
So I am stuck with X5 until they boot me out!

My real beef includes the non-supply of an item I won and paid for... only to be told that the item was not available due to a "faulty" condition. I enquired how they determined if the item was faulty if it was factory wrapped and sealed. I have not YET received a response.
I asked for a refund after they suggested another item similar in style and price.
This seemed to me to be more of an eastern style "bazaar".

I received a refund into my Paypal account 8 days later after several complaints from me and following a threatening email from me to accounts... less $1 (for some fee somewhere).

The "ab circle pro" I purchased for $94.05 at the samre time arrived quickly, However the speed of delivery was soon diminished by the damaged (dents & scratches) of the ab circle. To boot one of 2 metal sleeves required was missing! Without this the ab circle would be irreparably damaged.

I have failed to convince X5 (James) that the goods are damaged and he went as far a charging me with making a false claim.

I rang and notified the NTCC, and the offices of fair trading (NSW & NT) & they have noted their records accordingly. I also complained bitterly to Paypal who claim that they cover Ebay auctions only. The only case they would accept for investigation was either non receipt or receipt of substitute goods. They have no jurisdiction over the condition of items (outside of Paypal).

All I ask for from X5 is a physical address so I can return the item for a refund, but to date I have not been given the opportunity or address.
I believe that there is a 7 day cool off period in both states? (I stand corrected)

I was asked to supply a statutory declaration to their company solicitor.
I politely told them that my email was the only "stat dec" they would receive from me.

I have suggested to Paypal and authorities that X5 should be banned from the internet or at least be prohibited from holding auctions online.

I hope this helps someone make an informed decision about X5.

My opinion?:
I believe that "shill" bidding occurs within X5 although I have no proof. I believe and have experience of an organisation that rips off the members.
I would NEVER recommend this company.
