Refusal to refund joining/program fee on closure of this particular franchise of Healthy Inspirations

Healthy Inspirations Elanora is a franchise of Healthy Inspirations. The owner of Healthy Inspirations Elanora advised members on 14 May that her Centre would be closing on 31 May due to her not being able to negotiate a sustainable rental increase with the Pines Shopping Centre Management. I paid a joining and program fee just six weeks ago and, even though they must have been in negotiations for renewal of lease at the time (or possibly already having terminated their lease) the owner is now advising she will not refund my joining/program fee. On 14 May a temporary booth was set up within the Pines Shopping Centre by a Gym called 'fit girl club' (fitgirlclub.com.au) who advised they were taking over the lease of the current Healthy Inspirations Centre and would also be extending into an adjoining premises and building a new gym which is due to open on 30 June. fit girl club were taking and confirming memberships from 14 May and all of their literature (and website) shows the address as that of the current Healthy Inspirations Centre. They were also showing detailed architect plan of the extension to the building and internal plans. I have therefore (along with most of the Healthy Inspirations Elanora members) joined this new gym. I arranged a meeting with the owner of Healthy Inspirations Elanora to request a refund of my joining/program fees, which she has refused to do as she is now saying she is looking into possibilities for the continuation of our "health and weight loss journey elsewhere"!. It is more than obvious to me (and many others) that negotiations on renewal of a lease normally commence at least three months prior to expiry date. Therefore I believe the owner has taken my joining/program fee under false pretenses. I am currently trying to ascertain from the Pines Shopping Centre Management the actual date the lease was terminated.
