X5 delivers damaged items, substitutes purchased items with other items and purposely advertises items incorrectly. NSW

This site is a reverse Auction website. People pay to bid on items. Yet the items delivered to the winner are not always what the item was. Therefore not only is the winner/purchaser of the item ripped off but so are all the bidders who lost the auction.

The X5 team offer refunds to the winner of the returned item but do the bidders who lost but paid refunded? No. So who profits out of this when the item goes back up for auction? Seems like only X5 Technology Australia.

How can an advertised TWIN LENS KIT SLR camera come without lens?

My purchases from this site were:

2 x remote control boat toys and when I complained nothing happened.

1 x remote control BMW X5 toy but they delivered a remote control Mini toy car and when complained they delivered a non remote control Diecast Nascar toy.

3 x Aluminium cases and they delivered two severely damaged cases and one of those was without a handle and when I complained they delivered two further minor damaged cases.

1 x Canon 1000DTKB TWIN LENS KIT Camera EOS SLR - they delivered a Canon 1000D BODY ONLY camera and when I complained they stated "If you are still insist we are sending you this camera from supplier with no lens is a mislead or incorrect item, please visit the item description. Please note all item sell in digital camera especially SLR, lens is sold separately. I would advise you ask professional photographer or any other seller about this confirmation. Since you are not happy with this, you simply send back the item and we take care for the refund."

Do you see BODY only anywhere as all I see is a TWIN LENS KIT camera.

As for the send back the item and I will be refunded... what about all the people that bid (at a cost) on this item? Yes, you might get a buy from shopping at this website but what you get is not what you expect or bid on.

*These cameras clearly state BODY and I like anyone would expect solely the BODY but on those above it clearly states a TWIN LENS KIT and that is what one expects:

These cameras make no mention of a lens and therefore based on the statement of X5 (seen below) these would not come with any lens but I, like most people I have shown would presume it comes with the single standard lens:

I have since discovered that another Item I bid on but lost also contains 'misleading' information:

This Laptop computer Item states 2GB RAM in the title yet the description states 1GB.

Any threatening email will only result be banned at X5.
Please note, we are here to reply your email, if you do not check your X5 inbox replied then it is not X5 problem.
But if you here to threaten, you can just go straight to Fair Trading and we just show them the proof you do not replied or not even read our reply.

I have been using the INBOX for the last month. The latest reply from Sam in that INBOX, was to send an email to this email address with the Item numbers and I did just that. Additionally James I included a cut
and paste of his response in the email so the reader at this email address understood why I was emailing them.
If there is a problem James then you should not be taking it out on me, but on the X5 management or Sam who are sending out damaged and/or incorrect items to people including me and then advising them to send an email to this address.
This has been going on for ages James and the only replies to date that I have received are badly written english statements that basically advise me that they will correct the problem. But all I get are items I did not purchase and the items I did purchase don't arrive. If there is a problem at X5 and they are seriously wanting to correct the series of blunders that keep occurring then I have provided my phone number on numerous occasions to hear it. I am more than happy to discuss the issue James with yourself or
whoever at X5 if needed.

Nor is the camera a twin lens kit when the Order clearly states BODY ONLY and the box states NO LENS. (Photos and camera Order were included)

Since you are not happy with this, you simply send back the item and we take care for the refund.
Regarding the RRP $15xx and our cost is $600 . Please note, if our cost is $15xx then RRP is not $15xx anymore.
I am sure you understand what is RRP. Rather than debate with you as X5 client, we prefer you send back and we refund this transaction. As per your action, you pay for this camera is $40 plus postage and you claim all your payment thru X5, this is not a purchase one item, you have most of the credits on other items but you are still claiming all of this under 1 item.
If this is the case, please send back all the items and we will proceed for the closure of this dispute via refund.

Cameras that are sold as TWIN LENS KIT are a Camera BODY and TWO LENS.
Cameras that are sold as BODY ONLY are solely the camera BODY ONLY.
Cameras sold on X5 as BODY ONLY clearly state that.

I have seen many other items on X5 that have clearly stated BODY ONLY. I purposely avoided bidding on a BODY ONLY cameras and that is why I bid on an item that was explicit both in the TITLE and DESCRIPTION of the item with the words TWIN LENS KIT.
I understand the RPP perfectly and the X5 values always quoted on items also reflects that when it is a Camera BODY ONLY item and a TWIN LENS KIT item and once again, that is the reason I bid on this item. I can quite easily purchase the TWIN LENS KIT CAMERA for under $850 and a BODY ONLY for
under $600.
I have received two Remote Control Boats that that do not work. A Diecast Nascar instead of a Remote Control BMW X5 car. Two damaged items which were then replaced with two further damaged items. A BODY ONLY camera instead of the advertised TWIN LENS KIT camera and you resolve this by having me pay to send the items back to you to receive a $40 refund.
You additionally advise me to speak to a camera professional but I have no idea why because the Canon 1000D, like numerous other cameras can be purchased as BODY ONLY, or BODY and LENS, or as a TWIN LENS KIT.
I thankyou for your response but unfortunately it does not address my problem nor the fact you are misleading the public in so many ways.

I bid and purchased on items on the X5 website as did many others X5 clients. They like me expect that the item or items we are bidding on, are as stated and that when the auction closes, the item or items as
described are delivered to the winner as stated, especially when it has been confirmed and paid for.
My auction win of the Aluminium cases was by error (my error due to being a new X5 client). Yet I, being the honest person I am, CONFIRMED the WIN even though in X5 broken English I was advised that I was not obliged to confirm the win.
When these damaged items arrived (damaged before transportation), I politely advised the X5 team of this including the incorrect item (Remote Control BMW X5) and of the two other non functioning Remote
Control toys. I was advised by the X5 team that the problems would be fixed.
I then also politely queried the delivery of the camera which was now overdue yet received no reply. I then received two further damaged cases and a diecast NASCAR toy in place of the RC BMW X5. Yet
still no camera. I politely again advised the X5 team of the incorrect toy delivered and I politely queried the delivery of the camera which was now well overdue. Please note that I ignored the two further damaged
cases that were delivered.
Then, I received a Camera BODY ONLY camera when the auctioned item I bid for and won, clearly stated a TWIN LENS KIT. And again I politely advised X5 of this and also stated that all three deliveries I received contained wrong items. Clearly something is wrong when just one X5 client receives wrong and
damaged items in every delivery. X5 then advised me:

Not fully understanding what this wanted, I sent an email to the address as requested advising of the Camera item and RC toy that I was referring to and not knowing who the reader of that email was I cut and paste the X5 inbox messages so the reader would understand what this email was about.
I then receive a threatening email from James X5 advising me to use my X5 inbox and additionally that users sending threatening emails would be banned from X5 and that I should go straight to NSW Fair Trading. As such, I have done just that and as you are aware via PAYPAL.
Your request for me to return the items, so that you can continue misleading your clients, and then provide them with substituted items solely for your financial gain, is not a settlement I will accept.

Thank you for your email. We (James) do you write a threatening email. If you are not happy with the items, just send back.
If you are not willing to do so, then we advise paypal.
If you refer to nascar, we can replace for you. For the camera as per advised it is body only. When the case you are assuming including all the accessories, then we have no option of requesting for you to return the camera since you have claim through paypal.
Unless you want your money back and keep the camera. Then we will have no option informing paypal that you are not willing to return the items.
